Supreme Court Sides with Individual Rights!!!!!

[In an email received today from the ACLU:]

"The ACLU welcomed the U.S. Supreme Court's rejection of a petition forcing the reinsertion of Terri Schiavo's feeding tubes.

"The decision protects the severely brain-damaged woman's right to withdraw her own life-sustaining treatment and prevents politicians from interfering with intensely personal medical decisions.

"Earlier this week two federal courts also found no basis to set aside the legal procedures in Florida, despite attempts by Congress to interfere in the legal proceedings by the issuance of a Congressional subpoena.

"Terri Schiavo's wishes were honored today by yet another court that recognized her constitutionally protected right to refuse and withdraw medical treatment," said Howard Simon, executive director of the ACLU of Florida on Thursday. "If the court had ruled otherwise, the nation may have taken a giant step backward in the protection of privacy."

"The ACLU was co-counsel in the Florida case before Judge James Whittemore. The ACLU was also part of the legal team challenging "Terri's Law 1," enacted in October of 2003 to give Gov. Jeb Bush authority to re-insert the feeding tube. That case was struck down as unconstitutional by every Florida court; the U.S. Supreme Court declined to hear the appeal.

[The blogger just read today that it is indeed ironic that Bush and his Gang of Religious Nuts, and Abusers of Personal Rights and Liberties...are against the Medicare/Medicaid supports that Terri Schiavo would have needed for her life to be sustained, and are also against the rights of those who sue for malpractice, and that would have included the $1 million that Terri Schiavo got.

It is just more of the National Bu-shit that this evil administration is inflicting on the American people. They talk out of both sides of their mouths. They mean the opposite of what they say they stand for, and all they care about is MONEY, MONEY, MONEY. They could care less about individuals and their needs and rights. As long as they and their supporters are able to steal every damn cent of this nation (and more,) they are gleeful.

Their temple of worship is the off-short, secret, numbered accounts that they and their cronies have stashed away. There only desire is to add to those accounts...

SAD days have hit the USA, and the sluggers are all Republican, so-called Christians. Christ is blushing in Heaven over what is being done in His Name by Bush and his bunch of lunatic, fringe theives.

"Why, oh conservatives, why ... are you so quick to save the unborn, yet eager to execute criminals whose souls are just as precious and in need of rescue... preferably before death?

"Why, oh ye Christians, why ... are you prone to turn your backs on AIDS victims "who brought it on themselves" ... when surely if they did do so their souls are in need of great love and healing? For Jesus came to save the lost....

"Why, oh rich, why ... are you so eager to accumulate yet more wealth, when you can hardly spend all that you have already?

Spoof on the Goof -- Or Truth?

Saint or Devil? Two guesses...

"He snorted cocaine ... He dodged the draft....His friends knew him as an alcoholic womanizer with a bad temper....a complete failure at business until his wealthy friends rescued him. Yet within a few short years he was elected Governor of Texas, and quickly catapulted into the White House in spite of losing the popular vote. Then he was re-elected with last minute help from Osama Bin Laden, in spite of high disapproval ratings. He still couldn't think his way out of a wet paper bag without the advice of his staff .....and yet he's been able to declare an endless war and institute some of the most radical changes in American history ....

....... How has He done it?

Jesus Christ Returns to Earth; As Second Coming Actually Occurs, TV Evangelists Offer Insight

Jesus Christ, founder of the Christian religion and son of the monotheistic deity Yahweh, returned to Earth as promised last Tuesday morning. He quickly held a press conference which was broadcast live from New York City to "set the record straight" on a few things.

Pat Robertson of The 700 Club and founder of the Christian Coalition Jerry Falwell quickly appeared on the CBN network to offer live running commentary to help the faithful understand Jesus's cryptic, mysterious words.

"Hello everyone", Jesus began, "let me start by saying while there is an afterlife, there is no hell except for really, really vile people. You don't need to worship me to stay out of it. The name by which you call God is nowhere near as important as just being a good person".

"What the Lord is saying", Robertson began, "is that to be born again is the only way to salvation. He is speaking in a parable. And, by calling the number on the bottom of your screen, you can join our new Rapture Club and be saved today for a gift of as little as $5,000.00".

"Secondly", the Son of Man continued, "stop hurting others or imposing your will on others. I mean, its bad enough telling someone else what to do with his or her body or lifestyle, but its even worse when you do it in my name. And trust me, Buddah, Mohammed, even Zeus and Hera. Nobody up there likes it when you do that. Whether done to a person, a segment of society, or a whole nation".

"Pat", interjected Falwell, whose image appeared in the lower corner of the screen, "if I may field this one, the faithful have no doubt heard how the church fathers used to speak in tongues. That is what the Lord is doing here. It is obvious, to a person of faith, that the Lord is saying he supports the war in Iraq, and a constitutional ban on gay marriage".

Jesus then began a series of strange movements which one observer described as "rolling his eyes", and then another reports he "smacked his own forehead in frustration"..."That's it you two. Y'know, just cause I have to love everyone, doesn't mean I have to like everyone. I'd rather take another crucifixion than have you guys telling people that you speak for me", Jesus said..."

A Human Rights Memorandum To President Bush
by US Human Rights Network

The following is the conclusion to the letter:]

"The human rights situation within the US calls for serious self-assessment and reflection. Recent trends and events have raised significant doubts about this administration's commitment to human rights and have put the US at grave risk of becoming a place where human dignity and freedom are routinely denied. In order to emerge from the human rights crisis that we have begun to outline above, this administration must begin to put into practice its stated commitment to fundamental freedoms and human dignity by rectifying its abject failure to protect human rights both at home and abroad.

"We hope that this memorandum and the recommendations contained therein will help to set the administration on a path in the right direction. We will be following up this memorandum with a more detailed Human Rights Agenda for the Bush Administration and welcome engagement with the administration regarding ways in which we can bring US policy and practice in line with international human rights norms and standards. "

Karl Rove recently announced that he was setting up a "permanent campaign" -- modeled on Bush/Cheney ‘04 -- to force a sweeping right-wing agenda through Congress. We'll use a whole range of approaches depending on the issue: for example, letters to the editor of your local newspaper on Iraq, news conferences demanding election reform, town meetings on Bush's screwed-up budget priorities, bake sale fundraisers, or meetings between members of Congress and local citizens who can't afford a Social Security benefit cut.

And all the while we'll look toward the 2006 elections, to put pressure on vulnerable Republicans and support progressive candidates, using the techniques that worked well on our Leave No Voter Behind campaign last fall. "(January 24, 2005) The Preventive Psychiatry E-Newsletter today charged that the reason Veterans Affairs Secretary Anthony Principi stepped down earlier this month was the growing scandal surrounding the use of uraninum munitions (DU) in the Iraq War.

"Writing in the Preventive Psychiatry E-Newsletter #169, Arthur N. Bernklau, Executive Director of the Veterans for Constitutional Law Center in New York, stated "The real reason for Mr. Principi's departure was really never given, however a special report published by eminent scientist Leuren Moret's naming depleted uraninum as the definitive cause of the 'Gulf War Syndrome' has fed a growing scandal about the continued use of uraninum munitions by the U.S. Military.

"Bernklau continued "This malady [from uranium munitions], that thousands of our military have suffered and died from, has finally been identified as the cause of this sickness, eliminating the guessing. The terrible truth is now being revealed."

"He added "Out of the 580,400 soldiers who served in Gulf War I, of them, 11,000 are now dead! By the year 2000, there were 325,000 on Permanent Medical Disability. This astounding number of 'Disabled Vets' means that a decade later, 56% of those soldiers who served, have some form of permanent medical problems! (Editor's note" The 'Disabled' rate for the wars of the last century was 5% and 10% in Viet Nam.)

"Bernklau added "The VA Secretary (Principi) was aware of this fact as far back as 2000. He, and the Bush administration have been hiding these facts, but now, thanks to Moret's report, [it]...is far too big to hide or cover up.!"

"Terry Jamison, Public Affairs Specialist, Office of the Deputy Assistant Secretary for Public Affairs, Department of Veteran's Affairs, at the VA Central Office, recently reported that 'Gulf Era Veterans' now on medical disability, since 1991, numbers 518,739 veterans," said Bernklau.

"The long-term effects have revealed that DU (uranium oxide) is a virtual death sentence," stated Bernklau. "Marion Fulk, a nuclear phycial chemist, who retired from the Lawrence Livermore Nuclear Weapons Lab, and was also involved with the Manhattan Project, interprets the new and rapid malignancies in the soldiers (from the 2003 Iraq War) as 'spectacular' and a matter of concern."

"When asked if the main purpose of using it was for destroying things and killing people, Fulk was more specific: "I would say it is the perfect weapon for killing LOTS of people!"

"(afrol News) -- Desmond Tutu, the former Archbishop of Cape Town and a Nobel Peace Price winner, has lent his name to the fight against homophobia in Africa and around the world. The prominent South African says homophobia is a "crime against humanity" and "every bit unjust" as apartheid.

"The former head of the Anglican Church in Southern Africa made these statements at the launching of the book "Sex, Love & Homophobia", published last week by Amnesty International UK. Mr Tutu has written the foreword to the human rights group's book.
"We struggled against apartheid in South Africa, supported by people the world over, because black people were being blamed and made to suffer for something we could do nothing about; our very skins," wrote the prominent Church leader. "It is the same with sexual orientation. It is a given," he added.

"Mr Tutu says he could not have fought against the discrimination of apartheid and not also fight against the discrimination which homosexuals endure. "And I am proud that in South Africa, when we won the chance to build our own new constitution, the human rights of all have been explicitly enshrined in our laws," he said, adding that he hoped this soon would also be the case in other countries.

"South Africa is so far the only country in the world where the constitution guarantees equal rights non-regarding sexual orientation. This is in stark contrast to most of South Africa's neighbour countries, where homosexulality often is punished by the penal code. Only recenty, a Botswana High Court ruling reaffirmed this legal practice.

"Yet, all over the world, lesbian, gay, bisexual and transgender people are persecuted," writes Archbishop Tutu. "We treat them as pariahs and push them outside our communities. We make them doubt that they too are children of God - and this must be nearly the ultimate blasphemy. We blame them for what they are," he adds.

"He also very much regrets the dominant view among his church colleagues. "Churches say that the expression of love in a heterosexual monogamous relationship includes the physical, the touching, embracing, kissing, the genital act - the totality of our love makes each of us grow to become increasingly godlike and compassionate. If this is so for the heterosexual, what earthly reason have we to say that it is not the case with the homosexual?" Mr Tutu asks.

"Also within the Anglican Church, homosexuality is highly controversial and an ongoing conflict has threatened to split the global Anglican Communion. The current head of the Anglican Church in Southern Africa, Njongonkulu Ndungane, has been an outspoken supporter of including homosexuals in the Church community, putting himself in a strong-worded conflict with other African Church leaders.

"In its new book, Amnesty reports on the life stories of gay and lesbian people around the world. These include Poliyana Mangwiro who was a leading member of Gays and Lesbians of Zimbabwe despite President Robert Mugabe's protestations that homosexuality is "against African traditions".

"The book also includes the story of Simon Nkoli, a South African ANC activist who after spending four years in prison under apartheid went on to be the face of the struggle for gay rights in the new South Africa. Further stories of hate, fear and persecution are reported from Nigeria, Egypt and other countries, in addition to reports from the states where homosexuality is punishable by death; including Sudan, Mauritania and some Northern Nigerian states.
For Archishop Tutu, these "destructive forces" of "hatred and prejudice" are an evil. "A parent who brings up a child to be a racist damages that child, damages the community in which they live, damages our hopes for a better world. A parent who teaches a child that there is only one sexual orientation and that anything else is evil denies our humanity and their own too," Mr Tutu concludes."

There Is Hope -- In Never Giving Up

[The following was received from an associate in Norway, who shall remain nameless to protect his anonymity since I do not have his permission for attribution. His view gives the perspective of one on the outside looking in at our 'conditon' here in the USA.

It speaks to our condition here in the USA, during a time under neocon control via the Bush administration. It is all in all a message of hopefulness; which is what this country needs. The religious right is ready for 'their ascension into Heaven via the second coming.

What most of us await is the first coming of REAL Christianity. There has been little evidence of it since Jesus left us. If the bigots and fundie-minded would but adopt a Christ-like way of living, and seeing the 'other' as neighbor, there might be hope for a speedier end to this new variant of religious oppression.]

"I am aware that the legislative issues are different in Europe and the US, but I still would think that it ought to be perfectly possible to deal with the different judicial aspects like property and inheritance rights on a national level, and to make that inclusive of several types of domestic partners - not only gay partnerships.

"This way, the whole process of lobbying etc would be given added weight by several groups of citizens. Within the context of the gay organizations working side by side with other interest groups, a lot is gained just from that fact. I am only mentioning here what has come up in discussion with friends in the US, so I know there are people in your country that think like this.

"It certainly looks as if the religious right are hard to beat right now on their Bible-quoting home-ground, but there are mechanisms in the US political machinery I truly know too little about so I am not going to even try to argue for anything here!

"The raw hatred you speak of [from the religious right,] I have in truth limited experience with, although it surely exists also on this side of the Atlantic. The USA clearly has a much tougher climate than any European country, and in many ways this is so -- for so many Americans, it is the only KNOWN way.

"The stupidity -- I see relatively clearly, and it appears more frightening really. We have a saying here that 'a battle against stupidity is a lost battle' - (I don't think I've heard the English equivalent of that one, but that sounds pretty much to the point.

"I will say this: when I left the US last summer, I was elated (and I don't use this term by chance) to be able to return to the (relatively) peaceful haven Norway is compared to the US; and not only because me and my (now ex-) partner were breaking up.

"There was a very noticeable sense of unease present in most people I knew and was surrounded by, it felt as if stress levels were increasing day by day, and most were very aware of this and the reasons why this was/is so.

"The US has changed a lot over the last 4 years; perhaps it is mostly a process of coming to terms and dealing with what has always been there, to a lesser or greater degree. But you know what? People are waking up also in large numbers. So, I know there is HOPE; and hope is pretty much the same as never giving up(or shutting up.)

"I won't."

Doctors urged not to operate on infants with unclear gender -- Associated Press Feb. 18, 2005
WASHINGTON –

"It’s the first question new parents hear: girl or boy? But hundreds of babies are born each year where the gender isn’t clear. Prompt surgery to assign one was once the norm.

"But gender depends on more than anatomy or hormones. It also seems to stem from the very earliest brain development, researchers said Friday in urging doctors to hold off on the knife until children can determine their own sex.

To discover who or what a child is ... you have to ask them,” Dr. William Reiner of the Oklahoma University Health Science Center told a meeting of the American Association for the Advancement of Science.

“There is no one biological parameter that clearly defines sex,” added Dr. Eric Vilain of the University of California, Los Angeles, whose research suggests gender is genetically hard-wired into the brain before birth — regardless of which genitalia develop.

"The issue is “intersex,” the name for numerous conditions that result in roughly one in 4,000 babies born with both male and female traits.

"Think twice before surgery

"One of the more common is congenital adrenal hyperplasia. In such cases, genetic girls with XX chromosomes are exposed in the womb to such high levels of androgen — the hormone that triggers male development — that they appear male externally even if they have female reproductive organs. A different condition leaves genetic males less responsive to androgen during development, so they’re born without a penis.

"The parents must pick a gender somehow, to know what to call their child and because gender is required on a birth certificate. So specialists check non-obvious factors such as which sex chromosomes the child has and levels of sex hormones in the blood.

"But Vilain’s research suggests there are factors at work that can’t be measured. The scientific dogma used to be that hormones alone could “masculinize” the brain, he said. But he identified 54 genes that work differently in the brains of male and female mouse embryos just 10 days after conception — before sex hormones are ever produced.

"Doctors also once thought that how people were raised and their genitalia were enough to determine gender, said Reiner, who as a urologist performed sex-assignment surgeries on babies.

"But Reiner began seeing children who had been assigned to one sex as babies and a few years later began identifying themselves as the other. He re-trained as a psychiatrist to study these children.

"His latest review of 94 intersex children found over half of the genetic males “transitioned” to become boys despite being raised as girls and undergoing female surgical sex assignment.

"How? As early as age 4½, the children would suddenly say, “I’m a boy,” or pick a boy’s name, Reiner said.

"Hence his advice to parents to think hard before agreeing to surgery for an intersex baby: Dealing with the social trauma of switching gender later is enough without the issue of surgery that can’t be reversed.

"Legal Hurdles

"Aside from the emotional trauma of such a switch are legal issues. Virginia Harmon of Chevy Chase, Md., was born with Klinefelter Syndrome, where instead of the X and Y chromosome of males, people have an extra X chromosome. She was raised as a boy, but at age 14 began developing breasts and “began negotiating with my parents” to transition to a girl. At 25, she had female sex-assignment surgery.

"But law in Texas, where she was born, doesn’t allow her to change her birth certificate, which still states that she is male — so she couldn’t marry a man there.

"Indeed, most U.S. law assumes that everyone is clearly male or female, putting up hurdles for everything from name changes to marriage for intersex patients assigned the wrong gender, said law professor Susan Becker of Cleveland State University.

"So what should parents do? Get as much information as possible on the child’s physical and genetic condition, Reiner advises. He puts parents in touch with the Intersex Society of North America to hear personal stories.

"And more doctors are putting off sex-assignment surgery, he said. A recent survey of pediatric urologists found two-thirds would call genetically male babies boys even if they have no penis — while five years ago almost all would have recommended raising them as girls.

“Then if at age 12 they say, ’No, I’m a girl,’ at least you haven’t damaged anything,” he said."

[I can see the religious right thought-police scratching their heads a-wonderin' how a good, God fearin' Christian should respond to such things that are plainly not covered in their IDOL, the Bible. "The Royal Navy is to place advertisements for recruits in the Pink Paper as part of a new campaign to recruit homosexual sailors.

"The move follows its decision to sign up to the Diversity Champions programme run by the equal rights charity Stonewall, the first time a branch of the armed forces has done so.
Commander Tim Kingsbury, the Royal Navy's diversity and equality policy officer, said the scheme would initially involve providing commanding naval officers with the necessary information to best understand and support homosexual staff.

"He said Navy top brass still "needed to understand better the needs of one group of personnel and to encourage them that they are part of the mainstream"...

[Blogger: Why is the USA military scared to death of having open homosexuals in its ranks? Could it be because they would recognize the closet gays already in the military and put them at risk of discovery? Could it be they are so sorely tempted to have same-sex sex that the presence of open 'opportunities' to do so would be just too much to resist? Could it be that they are so insecure with their own sexuality that someone that is confident in theirs is seen as a great threat? Could it be that they are bigger pansies than the pansies? It is downright laughable.

For God's sake, even the Israli Army has openly gay members. All Isralis are required to serve in the Armed Forces. Now THAT is a wonderful idea! The rich and privileged could have an opportunity to show their own worth in the trenches? It is past time for that to happen.

The rest of the world already views the USA as a bunch of paranoids -- maybe we do have the serious disease of homophobia. Historically we have been paranoid in our race hatreds too -- look at the Native American genocide our CHRISTIAN founders of this nation allowed and even participated in. Look at the hoodlums in white bedsheets, in the closet with their big-penis-envy and unmasked race hatred. That folks is pathological.

Now torture is added to the list, and we see a pattern beginning to form. The repressed, puritanical sexuality of the moden US citizen is sick, sick, sick -- even to including getting off on the humiliation and torture of another of God's blessed creatures.

Why doesn't this reach the mainstream press? Have we become a nation of cowards, hiding behind our phallic guns really big orgasic-trons, the nu-clur weapons. Maybe we see the depleted uranium being scattered widely over all of Iraq as our seed being spilt. Yep, we have a Onan of cosmic proportions in that one.]
